Recently, in Dey Pharma, LP and Dey Inc. v. Sunovion Pharmaceuticals Inc., 2011-1507 (Fed. Cir. April 16, 2012), the Federal Circuit clarified the parameters under which a United States court has subject-matter jurisdiction over declaratory judgment suits filed under 28 U.S.C. § 2201 by an Abbreviated New Drug Application ("ANDA") filer.
