With the new First-Inventor-to-File system, the America Invents Act of 2012 has ushered in a particular set of challenges for universities and technology centers. Historically, these institutions wait to file patent applications until they receive financial support from an interested commercial vendor. Robert Greene Sterne suggests that in light of the new patent system, universities and tech transfer offices should review their business models to determine how they will protect their R&D and build their patent portfolios prior to going public with their innovations.
